Personal information is usually provided to us by individuals or
entities to provide Motor Valuation, Damage Assessment, and any other type of
Inspection Report. These reports are required to contain some personal
information.
We may also receive your personal information indirectly from,

Why we have personal information
Under Jamaica’s Data Protection Act, 2017, the lawful bases we
rely on for processing this information are:

Your consent. You are able to remove your consent at any time. You can do this
by contacting the Data Controller Representative at MSC McKay Jamaica Limited
in writing.
(b)
Under our registration as a Loss Adjuster under the Insurance Act, MSC McKay
Jamaica Limited has an obligation to provide entities reports
that are required to contain personal information.
How we store your personal information
Your information will be securely stored on Amazon Cloud Servers
located in the State of Virginia in the United States Of America and is also
protected under The Virginia Consumer Data Protection Act (2023). These servers
utilize encryption in the transfer of data and are protected from unwanted
intrusion by using the latest industry-standard protection. As our reports may be used for Legal (Eg:
Court cases, Estate settlements) as well as Financial matters, we presently
retain all report information indefinitely.
Your data protection rights
Under the Data Jamaica’s Data Protection Act, 2017, you have
rights including:
Your right of access – You have the right to ask us for copies
of your personal information.
Your right to rectification – You have the right to ask us to
rectify personal information you think is inaccurate. You also have the right
to ask us to complete information you think is incomplete.
Your right to erasure – You have the right to request the
erasure of your personal information in certain circumstances.
Your right to restriction of processing – You have the right to
ask us to restrict the processing of your personal information in certain
circumstances.
Your right to object to processing – You have the right to
object to the processing of your personal information in certain circumstances.
Your right to data portability – You have the right to ask that
we transfer the personal information you gave us to another organization, or to
you, in certain circumstances.
You are not required to pay any charge for exercising your
rights. If you request by email or letter, we have one month to respond.
